The proposals in the Personal Care at Home Bill that has become an Act under the "Washing Up" Procedure was a badly thought out piece of legislation. It is typical of Labour who, like the Conservatives, is more interested in gaining votes than helping the frail and elderly. The Liberal Democrats in the Lords managed to improve it substantially.
When the public finances are in such dire straits, it is vital that new money is carefully targeted at those who need it most. It is important that this Bill is reviewed early in the next Parliament. Councils who will have to implement its provisions will have to make cuts elsewhere to afford it.
Though there are challenges with uptake when services are means tested, the consequences of not doing are even worse. An independent review was won as an amendment before being passed and this, with delaying its implementation until 2011 will at least give the next Government an opportunity to reconsider it.
This is a good example of why we need a complete overhaul of the drawing up of legislation especially in the approach to General Elections.
